Carmel Valley incorporation vote doesn't need an EIR, judge rules.

The last of the pending court challenges related to Carmel Valley's Nov. 3 incorporation vote has been denied.
On Oct. 27, Judge Kay Kingsley of the Superior Court in Monterey rejected nine arguments for stopping the vote, including issues related to flood control, affordable housing and development.The plaintiffs had argued that an environmental impact report should be completed before a vote takes place.
The decision is a win for the Carmel Valley Forum, which supports townhood, and a setback for incorporation opponent Frank Lunding and his development group, Planning 2020.
Lunding also lost an earlier lawsuit challenging the incorporation effort. In 2008, Monterey Superior Court Judge Lydia Villareal ruled that LAFCO was wrong to require an EIR for the incorporation process.
