Anyone else out there notice how quiet this case has gotten? Do you think the County has finally gotten the notion that they have a crap sandwich on their hands? The 995 filings are due shortly and besides a request for dismissal of all charges it should show the causal malfeasance of the County. By the way, I have now spoken to one individual who was interviewed by the Feds, he refused to tell me anything about his interview (smart, I am sure the Feds required a non-disclosure) but they are here.......
Thanks, Granny, my son has educated me on the Hobbs Act, good call. Collins, in one of his mails referred to a "Special Liability Fund" set up in September, 2011, to deal with expenses relating to him. I will look up the filing you are referring to, but essentially you are saying the County BOS paid the DA's bills to go after Collins? The DA did not spend $2M+ of their own budget to pursue this case? This is way out of my league, but I will pass the info on to my son, just common sense tells me there is something seriously wrong with this scenario.
Well, well, well, the County of Monterey has screwed Collins every legal way you possibly can and now his new attorney is moving for dismissal, recusal of the Judge, most likely a move to a new jurisdiction (State Attorney General) and at least two sitting Supervisors, plus senior staff are being investigated by the Federal Government for conspiracy, fraud and corruption charges. My son has a great deal of experience dealing with Federal investigations and once the hook is set, they are tenatious.
This is such a stupid case and so unnecessary, but the County needed a "fallguy" to kill the Regional Project. Has anyone actually ever bothered to look at the charges filed against Collins? Two counts of conflict, for supporting two contracts he was asked to help write by the County BOS, and missing several meetings in May, 2011, with Calcagno and Potter that he allegedly billed Ocean Mist for, while on a monthly retainer. Why was this any business of the BOS? These are the same two miscreants being investigated by the Feds for fraud, can anyone guess why the County does not want these two Sups on the stand? Can you imagine the interview questions the Feds will have for Weeks, McKee and Grant?
My son tells me that the most likely outcome for all of this is a quiet settlement with "confidentiality agreements" everywhere. Unfortunate from an entertainment standpoint, but smart for the County, Collins and a new water project.
I have been wondering why Collins is all of a sudden so quiet, now my son confirms the Federal investigation and the 995 Filing will set this case on its ear. Burt has probably pulled in Collins reins, pity, it was very informative. I am also sure, (my son is anyway), that the information is better presented in front of a Federal Grand Jury in San Jose rather than to Collins audience.
My son has now verified through a second source that individuals are being interviewed and voluntarily giving information to Federal agents. It took awhile, but alas, Mr. Collins, you are swimming upstream no longer.
Everything in its own good time, Collins' new attorney's filed a 995 Motion this morning, a motion to Dismiss all Charges, that will be heard by a different Judge. My son is salivating over the opportunity to read the detail filings. The predictions from above are slowly coming to fruition (my son's) and the County will be back to testifying.
The rumors of the Federal investigation are rampant and a California DOJ complaint has been filed, as well as an additional FPPC complaint (big deal). The County's conspiracy and fraud in this case are about to be exposed and it could not happen to a nicer bunch of folks. Can you say "I plead the 5th?".
I can hear the BOS now, "we had no knowledge, Weeks, Grant and McKee lied to us, we are innocent victims". Even "Infectious Pernicious Irvgrantitis" will not be a defense here. This case will be rapidly moved to the Attorney General, with the DA being recused, and all hell is going to break loose, should be entertaining.

My guess (actually my son's) is that this is about to get yanked out of Monterey County entirely. I can hardly wait to read the data in the 995 motion, Oh Lord, County of Monterey what you have sown.........
