Monterey Serves Warrant on Marijuana Dispensary

The city of Monterey served an inspection warrant on My Caregiver, Inc., on Lighthouse Avenue in New Monterey, based on information that the business is violating a court order to stop dispensing medical marijuana. City inspectors forced entry into the business on Friday morning, according to a statement issued by Fred Cohn, assistant city manager.

The business had been ordered to stop storing and dispensing medical marijuana, and the assistant city manager said officials had reason to suspect the business continued to do so. The court injuction was issued after the city took My Caregiver to court for violating city code, which does not specify medical marijuana as a permitted use in retail shops in Monterey.

“This isn’t about medical marijuana. This really is about conducting a business that isn’t authorized in the zoning ordinance,” says Cohn. “The fact that it’s medical marijuana is immaterial."

Cohn says he cannot recall any other instance in which a business has not complied after being cited by city officials for a zoning code violation.

The city is still evaluating evidence from today's inspection and has not yet determined whether My Caregiver was in violation of the court order and continued violation of city code.
